30 Startups supported by StratJuris Partners in 2016

"Start Up India Stand up India” is a Scheme launched by Department of Industrial Promotion and Policy (DIPP). Please  details at The scheme has started accepting applications since the beginning of this Financial year from entities (Companies, LLPs and Partnership Firms) to be recognized as Startups via its website and Mobile Application. Already about 500 entities have been registered as Startups.

StratJuris Partners is a Law firm that focusses on drafting and filing of Patent Applications for Startups. A Patent application filed and published in the Journal by the Indian Patent Office in areas affiliated with the nature of business being promoted by the Startup can be used as a registration document for the scheme by such startup. The other alternatives to a Patent document are, documents that endorse the innovative nature of business of the startup including:

  1. a recommendation from any Incubator established in a postgraduate college in India; or
  2. a letter of support by any incubator which is funded govt (Central or State) as part of any specified scheme to promote innovation; or
  3. a recommendation, from any Incubator recognized by Government of India; or
  4. a letter of funding of not less than 20% in equity by any Incubation Fund/Angel Fund/Private Equity Fund/Accelerator/Angel Network duly registered with SEBI
  5. a letter of funding by Government of India or any State Government as part of any specified scheme to promote innovation.

Under the scheme DIPP shall bear the cost of Patent, Design and Trademark Attorney and the Startup has to only Pay 80% discounted Government Fee for Patent Registrations. There is no discount on Government fee notified currently for Trademarks and Designs.

Rs. 1600 is the filing fee for patent for Startups, wherein Patent application has up to 10 claims and 30 pages. Claim(s) beyond 10 is chargeable @Rs320 per claim and pages beyond 30 @Rs. 160 per page. Besides this the Startup has to pay Rs. 500 towards Stamp duty (in Maharashtra, it may vary in other states).

There are no restrictions on no. of Patent Applications that Startup can file. But only first 1000 Patent applications per year filed (Complete Specifications) by Startup will be Fast-tracked for examination. Please note that a startup ceases to be a startup 5 years after the date of incorporation, thus one has to utilize the scheme before your Startup turns 5.

The following two Government fees are optional and will apply only if you are going for Tatkal/Expedited/Fast track Examination (Examination to complete within 12 months)

Rs. 8000 for seeking fast track examination request

Rs. 2500 for early publication of patent application (Publication in this case happens in one month instead of 18 months).
